Dear Ratna, December 22, 2008 Merry Christmas to you and your family! Nice digs! Have you sold your second home yet? Below are pictures of my homes. I’d be really careful treating people as you and your organization do. You have absolutely nothing to fear from me (or anyone as far as I know) as I have virtually everything I want out of life with the exception of my health! Based upon the television shows I watch, there are a lot of people less forgiving than me! I’m thankful for the respite from the harassment of you and your staff. My stress level (and the pain that stress causes me as a result of my multiple neuralgias of the cranial nerves) has gone down considerably now that you and your staff no longer call me despite my many requests to confine your and their communications to letters, faxes, or emails. You’ll be hearing from my attorney(s) but as I have 5 years to file my lawsuit and am in no rush to get back into your harassment program, I’m in no rush. Sincerely, Eric A. Marquardt
. An Interview with Eric M. by Mimi Mimi: Why did you send Ratna a Christmas Card, are you close friends? Gus: When I received a copy of Sedgwick’s file on me I was shocked to learn that they had several photos of me they had taken covertly. There were accounts where I have been followed on numerous occasions on trips to the doctor, my son’s school, and short outings with friends. In addition they had found websites that I had posted things to. They spent over $7,000 for “private investigators” to follow me and trying to catch me living a lie and got absolutely nothing to indicate I haven’t been telling the truth about my condition. To discover this invasion of my life was really upsetting. I have always told them the truth about my condition and interestingly enough, they have never attempted to use the results of their surveillance to deny my benefits because I have done nothing inconsistent with my disability. I guess I wanted Ratna to know that your privacy is important and how you feel when it is violated. M: Do you believe sending a Christmas card to be a threat? G: Absolutely not. It’s just you feel so violated when you learn that you subject to being watched every moment of every day in an attempt to discredit your honesty. Every time I see a unfamiliar car on my street now, I wonder who is in it and what they are doing. When I get in my car, for whatever reason, I sometimes wonder if I’m being followed and check for tails. It’s not comfortable. I think Sedgwick employees need to feel how the people their paid to serve feel. M: I understand that Ratna Bagwe contacted the police regarding the Christmas Card, what did the Sergeant tell you when he called to advise you of Ratna’s complaint? G: He said he was going to turn everything over to the FBI and to the Postal Inspectors. I was very upset at this and told him I didn’t care what he and Ratna did. I did use very strong language, something I have never done with any Sedgwick or AT&T employee. He then offered a carrot and said Ratna would “drop all the charges” if I agreed to not contact her at her home again. I pointed out that in my letter they’d be hearing from my attorney and that I had no intention of contacting her again. I also told him I had done nothing she hadn’t done to me “ten times over” and would be happy to e-mail or fax him letters that I had written to Sedgwick and AT&T asking for Sedgwick not to phone me. In addition I offered to email him phone conversation where I had requested that they not phone me. I also explained that I had changed my outgoing voicemail message and had my brother (MD) request that all communications be mailed or emailed to me and I would respond. Sedgwick ignored all my requests and during the last two weeks, before my benefits were terminated, phoned me eight times. He, of course wasn’t interested in my perspective and we left it that he and Ratna were free to do what the liked but if any charges were brought against me, I’d file charges against her! That’s the last I’ve heard. M: Do you have any advice for Sedgwick employees? G: I’ve told them that if my boss told me I had to treat someone the way they’ve treated me, I’d quit rather behave the way they do. They make their living cheating people that are sick. I am getting by without the benefits I was promised as part of my employee benefits but I’ve read accounts of others that have had their power turned off, their vehicles repossessed, homes foreclosed upon, and other financial problems because their benefits were denied or cancelled when, in fact, they had a legitimate illness. One of these wronged people may take matters into their own hands and the results could be tragic. Sedgwick and AT&T employees mistreating the people they are paid to serve need to take a close look at how they treat people and potential outcomes. Years ago, my wife worked in a bank, wore a name tag, our phone number was in the phone book, and we got some threatening phone calls. The caller even described my wife! It scared us nearly to death! Back then, the only reference easily available to learn someone’s phone number and address was the phone book. In today’s world with the internet, you can’t hide! These people are very exposed. M: What are you trying to accomplish with this interview? G: First I want to make it clear that I am not threatening anyone. I live thousands of miles from these people and concealing any illegal activities would be virtually impossible with telephone records, computer records, and all of the investigative tools available to the authorities. I am hoping that by pointing out how vulnerable they are to someone that has “nothing to lose” they may adjust their behavior accordingly. M: What else are you doing to change “the system”? G: I’m working to inform our legislators about the abuses permitted under ERISA and hoping to get the laws changed. During my experience with Sedgwick I have documented everything. I have letters, emails, recordings of phone calls, my medical records, and lots of other things. I have all of them converted to computer files and have been sharing the complete package with legislators and many third parties. M: What are you doing now in regards to getting your benefits restored? G: The only option left to me is to file a lawsuit in Federal Court. I’ve turned everything over to an attorney and a complaint is being prepared. We have five years to file and as I don’t want to get back on their “programmed harassment” I’m not pushing for my attorney to put my case on the fast track. Time will tell and I’m sure we will win in the long run.
